ARCTIC BLUE MARKETING PTY LIMITED TRADING TERMS

Thank you for selecting the Arctic Blue Marketing range of promotional merchandise. Please take the time to read our trading terms to ensure we supply the best quality of service and advice to you at all times.

1. PLACING YOUR ORDER WITH ARCTIC

(A) Orders shall only be accepted after receipt of a signed purchase order or an Arctic Order Confirmation.
(B) Please ensure your written order includes all details such as delivery dates & instructions, sizes of garments, position of logo, quantity, size of logo and any other pertinent elements to the order.
(C) Shipment quantities of plus or minus 5% of an order are considered complete. You will be invoiced for the exact quantity shipped. Please note on your official order if the exact quantity is required.
(D) In the event of any inconsistency between Trading Terms and any Order or Invoice, the Order or Invoice will prevail to the extent of the inconsistency.

2. ACCEPTANCE OF ORDER

(A) Each Order placed by you on the Site is an offer by you to purchase a particular Product on the terms and conditions of the Sale Terms.
(B) Arctic Blue Marketing reserves the right to accept or reject your Order for any reason, including, without limitation, an error in your order or in the material on the Site, or the unavailability of the Product and may reserve the right to limit the quantity of Products purchased by you.
(C) The contract to purchase a particular Product only comes into existence upon acceptance by Arctic Blue Marketing of your Order. Products are subject to availability. In the event of shortage, Arctic Blue Marketing may allocate sales and deliveries in its sole discretion. Each accepted Order will give rise to a separate agreement between Arctic Blue Marketing and you.
(D) Arctic Blue Marketing will only accept Orders for delivery of the Products if the delivery address is a street address in Australia and only if you if you are a resident of Australia and over the age of 18 years.

3. QUOTE VALIDITY

Quotations are valid for 30 days.

4. PAYMENT

(A) A 50% deposit is required upon confirmation of orders over $20,000 or indent (offshore custom made) orders and must be paid on receipt of order. This will be invoiced on receipt of your written order.
(B) Our payment terms for credit approved customers are 30 days’ net of invoice. Invoices will be in soft copy and emailed to the purchaser or directly to the purchasers Accounts Department. Paper copies of all invoices can be requested.
(C) Initial orders are COD.
(D) All orders under $500.00 must be paid for before goods are despatched.
(E) Most products can be delivered within a three-week time frame. Due to the extra costs incurred, all orders requiring less than 10 days’ delivery time, will incur a 20% surcharge of the total order value.

5. ORDER CHANGE/CANCELLATION

No change or cancellation of orders permitted after production has commenced. Setup fees and any development costs will be passed on, including any sample courier charges incurred, should a cancellation of order be made before production has commenced.

6. DELIVERY

(A) To assist our team, please give the actual date of the function or event that the product is required for. While rush jobs can be accommodated, we all know these are the ones most likely to create problems.
(B) Normal production time for locally produced items is approximately 15-20 working days from receipt of your written order and artwork, subject to stock availability.
(C) Normal production time for indent orders is approximately 12-14 weeks from receipt of your written order and artwork.
(D) All lead-times are estimates only and may vary slightly due to the available production schedules, shipping schedules, “force majeure” and circumstances outside our control.
(E) Arctic Blue Marketing will endeavour to arrange delivery of the Products to the delivery point designated by you on your Order, provided the delivery point is in Australia.
(F) Any dates quoted by Arctic Blue Marketing in respect of delivery of the Products are estimates only and will not form part of the Trading Terms.

7. DELIVERY ACCEPTANCE

(A) Subject to any consumer guarantees under the Australian consumer law, unless you notify Arctic Blue Marketing by email, telephone or facsimile within seven (7) days of delivery and such notification is confirmed in writing within seven (7) days of its receipt by Arctic Blue Marketing, the Products shall be deemed to have been accepted by you as being in good condition and in accordance with the Trading Terms.
(B) If you fail to:
(a) accept delivery of the Products or any part of a Product when made available to you; or
(b) fail to provide accurate instructions, documents, licenses, consents or authorisations required to enable the Products to be delivered, Arctic Blue Marketing may, upon giving written notice to you, store or arrange for storage of the Products, and:
(c) risk in the Products will pass to you
(d) delivery will be deemed to have taken place; and
(e) you must pay to Arctic Blue Marketing all costs and expenses incurred by Arctic Blue Marketing (including storage and insurance charges) arising from your failure.

8. FREIGHT

(A) All products shipped from our warehouse is inspected and signed for by the carrier. We do not cover breakages once leaving our warehouse.
(B) Arctic Blue Marketing ships to all major capital cities overnight excluding WA, SA, NT and TAS. Please allow extra time for these destinations.
(C) All cartons are delivered to one destination. Arctic Blue Marketing will distribute your order to several destinations or separate the job into various quantities for you; however, a surcharge will be added to cover the extra time involved. Please discuss charges with an Arctic Blue Marketing representative.
(D) Arctic Blue Marketing is happy to expedite orders via airfreight or same day VIP couriers; however, this must be added to the final invoice.
(E) Freight is additional ex our warehouse.
(F) International freight charges will be quoted at the time of order. Please note there may be additional duty and tax charges applicable at the delivery destination. These charges cannot be confirmed until the goods have arrived into the country and are not the responsibility of Arctic Blue Marketing.

9. ARTWORK

(A) We require finished artwork in the form of vector artwork in either an eps., .ai or vector pdf file with all fonts converted to outlines. A jpeg file should be supplied additionally but not in place of the eps. file. Any art developed by Arctic Blue Marketing will incur charges and will be quoted to order. Set up charges are separate to artwork charges. Repeat artwork charges apply to most products.
(B) Due to the nature of the ceramic colours, we cannot guarantee an exact or identical match. The colour of the item will further influence the colour of the imprint.
(C) Please quote PMS colours if no colour reference is available.
(D) Please note that we cannot guarantee an exact match on the embroidery threads – PMS numbers will be used as a guide only.

10. PRE-PRODUCTION SAMPLES

The following prices can be used as a guide when ordering pre-production samples:
(A) Embroidery up to 5,999 stitches – $75.00 + $160.00 set up fee + the cost of the item.
(B) Laser Engraved one position engraving – $80.00 + $130.00 set up fee +the cost of the item.
(C) Pad printing – $70.00 + $155.00 set up fee per colour + the cost of the item.
(D) Screen printing – $70.00 + $115 set up fee per colour + the cost of the item.
When the order proceeds, set up fees are not recharged. Prices subject to change depending on the complexity of artwork provided.

11. WARRANTY TERMS

Contact us for any issues with the final products within the standard function and usage of the products or packaging supplied by Arctic Blue Marketing.

12. PRICES

(A) All quotes presented are subject to fluctuations in the Australian Dollar. Prices will be subject to change without prior notice, although this is an infrequent occurrence.
(B) Decoration set up not included in quotes. All website pricing subject to final artwork.
(C) Unless otherwise indicated on the Site, all prices include all Australian taxes.
(D) Unless otherwise indicated on the Site, you will be responsible for payment of all shipping, transport and delivery charges for your Order.
(E) You must pay to Arctic Blue Marketing the amount for any GST payable on a taxable supply made by Arctic Blue Marketing in connection with any Order unless the price for the supply is expressly stated as GST inclusive.

13. GENERAL

(A) Arctic Blue Marketing’s use of personal information collected in connection with your order or purchase of Products from the Site is governed by our Privacy Policy.
(B) Arctic Blue Marketing exclude all liability for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond its reasonable control.
(C) Arctic Blue Marketing may update, or discontinue any Product and/or revise prices for any Product listed as available on the Site at any time.
(D) You agree that changes may occur between any Product delivered to you and the Products described on the Site or in any marketing materials.
